Terms and Conditions
#### 1. Services Provided
1.1 Scheduled Maintenance Services: ENC Pool Service offers scheduled maintenance services for residential and commercial pools. These services include but are not limited to pool cleaning, water testing, chemical balancing, filter cleaning, and equipment inspection.
1.2 Service Renewal: Scheduled maintenance services automatically renew unless canceled before the service is due. It is the responsibility of the customer to provide written notice of cancellation at least 7 days before the service is due. Failure to provide written notice within the specified timeframe will result in the automatic renewal of the service.
#### 2. Service Fees and Payments
2.1 Service Fees: The fees for our scheduled maintenance services are outlined in our pricing schedule, which is available upon request. We reserve the right to change our service fees at any time, but any changes will be communicated to customers in advance.
2.2 Payment Terms: All payments are cash on delivery (COD) unless other terms have been established prior to service. A 50% deposit is required from clients before parts are ordered and before service is scheduled unless previously agreed upon for repairs/replacement of equipment. For equipment servicing jobs canceled after parts/materials are ordered, the client will be liable for the cost of purchasing the parts or a 50% restocking fee.
2.3 Late Fees: Late fees will be charged on overdue payments, and the greater of $35 or 4% will be applied as a late fee. Credit card payments are subject to processing fees, which will be clearly communicated to the customer at the time of payment.
#### 3. Customer Responsibilities
3.1 Access to the Pool: The customer is responsible for providing unrestricted access to the pool at the agreed-upon service time. It is the customer’s responsibility to ensure that the pool area is safe and accessible for our technicians. In the event that access is denied or restricted, ENC Pool Service reserves the right to charge a service fee for the missed appointment.
#### 4. Equipment and Supplies
4.1 Provided Equipment and Supplies: ENC Pool Service will provide all necessary equipment and supplies for the scheduled maintenance services. This includes pool chemicals, skimmers, brushes, and any other materials required for the proper maintenance of the pool.
#### 5. Liability
5.1 Limitation of Liability: ENC Pool Service will make every effort to provide professional and reliable services. However, we shall not be liable for any damages or losses arising from the use of our services, including but not limited to property damage, injuries, or any other direct or indirect losses.
5.2 Indemnification: By using our services, the customer agrees to indemnify and hold ENC Pool Service and its employees harmless from any claims, liabilities, damages, or expenses arising from the use of our services.
#### 6. Termination
6.1 Termination by the Customer: The customer may terminate our services at any time by providing written notice of cancellation in accordance with Section 1.2 of these terms and conditions.
6.2 Termination by ENC Pool Service: ENC Pool Service reserves the right to terminate the provision of services to any customer at any time, with or without cause. In such cases, any prepaid fees for future services will be refunded to the customer.
#### 7. Governing Law
7.1 These terms and conditions shall be governed by and construed in accordance with the laws of Wayne County, North Carolina, the jurisdiction in which ENC Pool Service operates.
